Important Notes

  1. Non-Convertible Visas:
    • Student KITAS and dependent visas issued for students cannot be converted into a KITAP (Permanent Stay Permit) in the future. However, they can be extended as long as the educational process continues.
  2. Remote Worker Visa:
    • The Remote Worker Visa (Digital Nomad KITAS) is non-extendable. To apply for a new visa or KITAS, the current Remote Worker Visa must be closed via EPO (Exit Permit Only) or ERP/ETK (Exit Re-Entry Permit) before leaving Indonesia.
  3. KITAP Eligibility:
    • Not all KITAS holders are eligible to apply for a KITAP. Only holders of Working, Dependent, Investor, Spouse, or Retirement KITAS can apply for a KITAP. More info: KITAP Eligibility.
  4. Family Sponsorship:
    • Holders of Working, Investor, Student, Second Home, and Golden Visas can sponsor a Family Dependent KITAS/KITAP.
    • Additionally, Indonesian spouses or relatives can sponsor family members for a Dependent KITAS/KITAP. More info: Dependent Family KITAS.
    • Retirement Visas cannot sponsor any dependents for a KITAS.
  5. Employment Visa Requirement:
    • The Employment Visa is the only legal way to work in Indonesia. Marketing or advertising from personal accounts (e.g., on Facebook or Instagram) is prohibited, even for company directors, as it may generate potential income. Therefore, such activities require a Working Visa.

Penalties for Immigration Violations

Violating Indonesia’s immigration rules can result in serious consequences, including jail time, fines, and deportation. Below are some key rules to be aware of:

  1. Working Without Proper Visa:
    • Working in Indonesia without the proper Employment Visa is illegal and punishable by fines or imprisonment.
  2. Marketing and Advertising:
    • Conducting business activities, such as marketing or advertising through personal accounts on social media (e.g., Facebook, Instagram), even as a director of a company, is not allowed without a Working Visa. This is considered income-generating activity and must be done under a legal Work Visa.
  3. Deportation and Blacklisting:
    • Foreigners found violating immigration laws may face deportation and a blacklist, preventing future entry into Indonesia.

By understanding the types of KITAS available and adhering to Indonesia’s immigration rules, you can ensure a smooth and legal stay in the country.
